This determination may be based on factors including, but not limited to, the number and nature of valid DMCA notices received concerning a user’s content. Account termination may occur without prior warning in cases of egregious or repeated violations.
False claims of infringement or counter-notifications made knowingly and materially false may result in liability for damages, including costs and attorneys’ fees incurred by the affected party.
